Emerging Coverage Issues Related to Cyber Risks: An Examination of Coverage under “Traditional” CGL and Other Policies

This program will examine emerging caselaw with respect to how courts decide coverage claims involving cyber-related risks and the terms of the specialty cyber insurance policies on the market.  Each year, companies, such as Target and Sony, face increased exposure to cyber-risks due to computer hackers, data breaches, and network interruption, which, in turn, cause significant expenses as well as numerous lawsuits by consumers.  As a result, they often seek coverage under “traditional” commercial general liability (“CGL”) and other policies.  The decisions reached by courts, however, have been mixed as to whether cyber-related claims are covered under these types of policies.  The seminar will address the various factors and issues that courts have examined in reaching their decisions and the trends emerging in this new area of law.  The seminar will also discuss responses by the insurance industry in developing new lines of cyber policies.
