What You Don’t Know Can Hurt You - and Your Client!

For a long time, HIPAA (Health Insurance Portability and Accountability Act) meant nothing more than signing an unread privacy statement when you went to the doctor’s office or a hospital. How things have changed! 

No longer the sole concern of covered entities like doctors, hospitals and health plans, HIPAA’s reach now extends to “business associates” (including law firms) of covered entities, and to business associate subcontractors. Breaches of health data must now be reported to the affected individuals and, in large cases, to the media and to HHS, which posts those breaches on its “Wall of Shame.” Annual data security risk assessments are now required. No longer a toothless tiger, HIPAA is now vigorously enforced by federal and state governments, as well as by the plaintiffs’ bar through class actions. HIPAA compliance audits will resume shortly. Fines and penalties have been enhanced. Criminal prosecutions for egregious violations have resulted in jail sentences. And all of this has occurred against the backdrop of sophisticated hacking attacks like the Anthem attack.
