New Jersey is among the most racially segregated states in the nation. Recent developments in federal law upholding and enforcing the so-called "disparate impact" standard for proof of discrimination under the federal Fair Housing Act, including U.S. Supreme Court's decision in Texas v. Inclusive Communities, the Mt. Holly Gardens decision by the 3rd Circuit, and HUD's new ”disparate impact” regulations, put into question the legality of zoning and planning decisions by municipalities that may have a disparate impact upon housing for racial minorities.
