About The Program:

Our July criminal law program is conveniently scheduled on an evening weekday and is designed to quickly move through the most recent hot topics in criminal law. Our panel of well respected defense attorneys and prosecutors will touch upon the most newsworthy criminal law areas of 2016 to date.


The topics covered at this program will keep you abreast of the developing areas in criminal law practice in NJ and their impact on your practice, including:
Search and Seizure Developments – With suppression motions being a large part of criminal practice, it is extremely important for prosecutors and defense lawyers to stay current with changes in the law. A review of recent search seizure decision from the last year with James Gerrow, Esq. will discuss State vs. Witt, which overturned the 2009 decision in State vs.Pena-Flores and expands the police authority for warrantless car searches. He will explain the exigent circumstances standard for warrantless urine collection under State vs. Verpent and more.
Underage Gambling – The Casino Control Act imposes penalties on underage gamblers and, in some cases, their parents. Topic will include a detailed discussion about representing clients in gambling cases. Atlantic City Municipal Court prohibits plea bargaining in underage gambling cases, forcing defendants to either plead guilty or go to trial. Mathew Teeter, Esq. will provide tips that will be your “best bet” for defending these cases.
Sexual Assault – The latest cases including State vs. Stubblefield, sexual assault and hazing, and more. Assistant Middlesex County Prosecutor, Sheree Pitchford, will review the newest developments in this specialized area of criminal law.
Latest Issues Involving Drug Courts – With the court rules requiring judges to advise defendants about the opportunity for drug court, it is important for lawyers to hear the latest updates on Track I and Track II cases including State vs. Gregory Maurer, State vs. Anthony F. Stalter and others. Assistant Deputy Public Defender Richard Nunes is assigned to represent client in Drug Court in Bergen County. He will shed light on the cases and arguments used when representing a client who faces violations and termination.
Speedy Trial and Bail Reform –This segment will address the latest news on the comprehensive bail reform that will be implemented in January, 2017. Topics include an overview of the pretrial risk assessment and speedy trial provisions of the legislation, summary of the recommendations of the Joint Committee on Criminal Justice and proposed changes to the Rules of Court. Kimberly Yonta, Esq., Chair of the Criminal Law Section, will follow-up with the latest information from the AOC regarding pretrial risk assessment and pretrial release and speedy trial from the law enforcement and defense
perspectives.
Megan’s Law – An international version of this controversial law is heading to President Obama for signature. Hear the latest on Megan’s law tiers, exemptions and motions to be removed from the registration requirements. James Maynard, Esq., Chair of the Megan’s Law Committee of the Criminal Law Section will comment on recent developments in the law.
