The practice of law (trial work in particular), has often been compared to “going to war.” Adversarial positions are taken, parties hunker down, and lawyers are left to their devices in trying to craft positive resolutions. The process is fraught with adversity. Negotiating oneself through this minefield can be a daunting experience. The brave men and women who fought in World War II faced the ultimate trials and tribulations. Staring adversity in the face, many of them made courageous decisions that went on to impact the entire human race. Fortunately, we can learn from their lessons in dealing with adversity.

Advocacy in Adversity: Trial Lessons from World War II will emerse you in gripping examples from that terrible period in world history to discuss lessons that apply to all lawyers. Through a series of well-curated and fast-paced vignettes from that epic war, you’ll will learn how to deal better with adversity, and how those lessons can be used today. As an attendee, you’ll hear how these examples relate to fairness, communications, impartiality, a lawyer’s responsibilities, and the applicability of RPC’s 1, 2, 3, 4, 6 & 8. Additionally, many of the examples have direct implications on successfully handling trials. As a participant, you’ll uncover an array of legal and ethical qualities involving advocacy that impact your daily law practice.

Among the many vignettes from the war, you will hear how Dwight Eisenhower managed the D-Day landing in the face of almost insurmountable obstacles, how Winston Churchill was able to bolster the flagging spirits of his fellow citizens in the darkest moments of the war, and how the courage of Anne Frank, the young Jewish girl who remained hidden from the Germans for two years, helped her overcome adversity almost on a daily basis. These are just a sampling of the real-life stories of adversity that will be covered in this seminar. You will also learn important lessons about handling high profile cases from the discussion on the Nuremberg Trials. By the end, you’ll find your professional and personal life greatly enhanced from this refreshing, innovative, and interesting CLE event!


NJ CLE information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 4.0 hours of total CLE credit. Of these, 2.0 qualify as hours of credit for ethics/professionalism and 4.0 qualify as hours of credit towards certification in civil trial law.
