EASL Blog Post: Comic-Con Lawsuit Over Trademark Infringment

By Stacey Lee Trien posted 08-11-2014 11:03 AM

San Diego Comic-Con, claimed to be one of the biggest comic book conventions in the nation, filed a lawsuit last Thursday in the U.S. District Court of Southern California alleging that Salt Lake City's use of "comic con" in its convention name, Salt Lake Comic Con, constitutes federal trademark infringement that will cause irreparable harm to the San Diego Comic-Con marks by confusing fans into thinking that the two events are somehow affiliated. After refusing to yield to a cease-and-desist letter from San Diego Comic-Con organizers last month, Salt Lake Comic Con is prepared to defend themselves in this action and point to the existence of dozens of fan conventions held every year across the nation that label their events as comic cons.

For those of you who are unaware of the growing popularity of comic book conventions, these are events that enable fans of various films, television programs, comic books, video games, actors, or even entire genres of entertainment (i.e., science fiction, anime, fantasy, etc.) to participate in programs and meet experts, famous personalities, and other fans.  Attendees are encouraged to dress up as their favorite characters.
