The Long and Winding Road…to Recapturing Paul McCartney’s Song Copyrights

Sir Paul McCartney recently filed a claim against Sony/ATV seeking a declaratory judgment that his copyright transfer termination notices are valid and that he will soon regain the copyrights to songs by The Beatles as well as his solo work.

Copyright transfer terminations have been in the news a lot since the first terminations went into effect in 2013. McCartney has been serving and recording termination notices for almost ten years, with the first recaptures going into effect in 2018.

McCartney is seeking a declaratory judgment in an attempt to have a US court decide the issue thereby avoiding a fate similar to Duran Duran. Late in 2016, Duran Duran were unsuccessful in their quest to recapture their copyrights when a UK court ruled that US copyright termination provisions were trumped by the interpretation of the contracts at issue under English law.

By taking this route, McCartney seems to be focusing on the US copyrights at this time, and perhaps will revisit the fate of the UK copyrights at a later time.
